Family Law

In the beginning, during, or upon the end of a relationship, we can help you by drafting a Relationship Property Agreement that sets out what is to happen to your property and/or how it is to be divided between you. Similarly, in regard to care of children in the event that you separate, we can help to resolve what the children’s care arrangements (if any) are to be.

The Law has strict requirements regarding what is required to bind parties to a Relationship Property Agreement and it is important to ensure that these requirements are met. We can advise you regarding what property should be regarded as separate property and therefore should not be divided between yourself and your partner.

Property Law

We offer a full range of property law services including : Sale and purchase of farms, homes and rural land, subdivisions, and commercial property sales, purchase of businesses and refinancing. Our clients range from first home buyers to serious property investors and developers.

The technical legal term for buying and selling of property is conveyancing, which means the legal transfer of title from the seller to the buyer in exchange for payment. If handled well, conveyancing should be routine and trouble free but there are many issues and potential pitfalls – conveyancing transactions which do go wrong can go very wrong. That is why you should never sign any agreement or documents relating to property without checking with your solicitor first.

These are some of the issues or potential problems which can cause complexities:

  • Is the property being sold described correctly?
  • Is the price correct and are there any GST issues?
  • What type of title is it and what encumbrances is it subject to?
  • Is the agreement (or should it be) conditional upon certain issues being checked out?
